Ho High Court Orders Substituted Service of Court Documents on MP John-Peter Amewu

In a recent development, the High Court in Ho has issued an order for the Member of Parliament for the Hohoe Constituency, John-Peter Amewu, to be served with court documents via substituted service. The court’s decision came in response to a motion filed by lawyers representing five individuals who had filed a lawsuit against Amewu and the Electoral Commission regarding the 2020 parliamentary election.

The plaintiffs, who come from the Santrokofi, Akpafu, Lolobi, and Likpe (SALL) areas, allege that they were denied the right to vote in the parliamentary election within the Hohoe constituency, which they argue violated their fundamental human rights.

Despite John-Peter Amewu’s victory in the 2020 election, the plaintiffs maintain that he should not be recognized as the MP for Hohoe because they were unable to participate in the parliamentary elections held on December 7, 2020, within the Hohoe constituency as defined under CI 95.

The issue at the heart of this matter is the creation of the Guan District, which incorporated the SALL areas in 2019 and was added to the Oti Region. However, a new constituency had not been established before the 2020 polls. Consequently, the Electoral Commission permitted voters in the Guan District to only participate in the presidential polls within the Buem constituency of the Oti Region.

The plaintiffs’ legal action seeks to uphold their fundamental human rights, specifically their right to vote and representation in the Ghanaian Parliament. Their efforts to serve the court documents on John-Peter Amewu had reportedly been unsuccessful.

The court, presided over by Justice Yaw Owoahene-Acheampong, issued a ruling outlining the terms of the substituted service. The court ordered that the documents be served on the 2nd Respondent, John-Peter Amewu, as follows:

1. By posting a copy on the notice boards of the High Court in Ho and the High Court in Accra.
2. By delivering a copy to the 2nd Respondent’s secretary in his office at the Ministry of Railways in Accra.

According to the court’s ruling, the service of these documents will be considered complete after a period of 10 days. This decision marks a significant development in the ongoing legal proceedings concerning the 2020 parliamentary election in the Hohoe constituency.
