
The High Court in Accra has struck out a suit filed by Democracy Hub challenging the National Democratic Congress (NDC) parliamentary primary in Ayawaso East, ruling that the action was incompetent.
Democracy Hub had sued the NDC, the Electoral Commission of Ghana (EC), and the Attorney-General’s Department. The group sought to restrain the EC from accepting and acting on the NDC’s parliamentary candidate for the Ayawaso East by-election, arguing that the party’s primary was marred by alleged vote buying.
However, lawyers for the NDC filed a preliminary objection, urging the court to strike out the suit on the grounds that it was defective and incompetent.
In his ruling, Justice Agyenim-Boateng upheld the preliminary objection and set aside the originating processes, effectively dismissing the case.
The suit centred on Baba Jamal, the NDC parliamentary candidate, who had been accused of engaging in vote buying during the primaries. Mr. Jamal has consistently denied the allegations.
A three-member NDC committee was subsequently set up to investigate the claims. The committee submitted a report that informed the party’s decision to uphold the primary results, citing compliance with legal requirements, constitutional provisions, and nomination deadlines established by the EC.
The EC has scheduled the Ayawaso East by-election for Tuesday, March 3, 2026.
