The Labour Division of the High Court in Accra is set to hear two ex parte applications on Tuesday, September 23, 2025, filed by eleven West African nationals who were deported from the United States and are currently being detained in Ghana.
The applicants are seeking two main reliefs: an interim injunction to stop their deportation to their home countries, and a writ of Habeas Corpus compelling the government to present them before the court to justify the basis for their detention.
During a virtual sitting on Thursday, September 18, Justice Priscilla Dikro adjourned the matter, stating that she needed more time to review the applications before delivering a ruling.
Lawyer for the applicants, Oliver Barker-Vormawor, insisted that the case was urgent, arguing that his clients had been unlawfully detained.
The defense further pointed out that President John Dramani Mahama has already disclosed plans for the deportations, a statement which was also confirmed by the Minister for Foreign Affairs.
If the interim injunction is granted, it will prevent the government from carrying out the deportations, while the writ of Habeas Corpus will require the state to provide legal justification for holding the detainees
