High Court Throws Out Chief Justice Torkornoo’s Judicial Review Application

The Human Rights Division 1 of the High Court has dismissed a judicial review application filed by suspended Chief Justice Gertrude Torkornoo, describing it as an abuse of court processes and beyond the court’s jurisdiction.

Justice Torkornoo had sought to halt her ongoing impeachment proceedings, invoking a certiorari application to quash the process. She argued that the proceedings violated her fundamental human rights and questioned the legality and constitutionality of the impeachment mechanism outlined under Article 146 of the 1992 Constitution.

Her application followed the rejection of three prior injunction requests at the Supreme Court, which also aimed to suspend the impeachment until the constitutional provisions on the removal of a sitting Chief Justice were interpreted.

In its ruling, the High Court stated clearly that it did not have the jurisdiction to adjudicate on the matter and deemed the application an improper use of the judicial system.

The impeachment process against Chief Justice Torkornoo is still underway.
