37 Military Hospital Fined GHS1,075,000

37 Military Hospital has been slapped with a fine of GHS1,075,000 for negligence that claimed the life of a 27-year-old woman during childbirth in November 2015.

The General Jurisdiction six Division of the High Court awarded the father and husband of the deceased GHS400,000.00 each for loss of expectations of life; GHS50,000.00 in damages of mental distress and, GHS100,000.00 to the baby, Yaw Nyamekye in damages for pain and suffering.

The court also awarded GHS50,000.00 to Yaw Nyamekye in damages for disfigurement; GHS50,000.00 in damages to primary caregivers and an additional GHS25,000 in damages.

According to a report sighted on Starr FM by GhArticles, the parties involved are one Captain Nyamekeye who happens to be the husband of the late woman who died after delivering her baby at the 37 Military Hospital, as well as the doctors who conducted her throughout her labour.

The court said, the first plaintiff is the father of the deceased and the second plaintiff is the husband (Captain Nyamekye) who is a military officer.

The Deceased before her death was a PhD Student at the University of Ghana, Legon.

The plaintiffs say that they opted for Cesarean Section as her mode of delivery but the doctors refused and put her through vaginal delivery.

The deceased bled profusely at the theatre and died after giving birth.

The court said two doctors who were crucial to this case Major Dr Agyare Gyan and one Dr Amofa all gave contradictory accounts and did not give any reason why the request was not carried out.
