The Supreme Court is scheduled to hear an application today, Tuesday, December 16, 2025, seeking to overturn the decision of the Tamale High Court that annulled the Kpandai parliamentary election.
The application was filed by the Member of Parliament for Kpandai, Mathew Nyindam, who is contesting the High Court’s ruling that nullified the December 7, 2024, parliamentary election results. Mr. Nyindam argues that the Tamale High Court erred in assuming jurisdiction over the election petition brought before it by the National Democratic Congress (NDC) parliamentary candidate, Daniel Nsala Wakpal.
In his application, the Kpandai MP is asking the Supreme Court to issue an order of judicial review to quash the High Court’s judgment, as well as all related processes and proceedings. He maintains that the election petition upon which the annulment was based was invalid and should not have been entertained by the lower court.
Following the High Court’s ruling, the New Patriotic Party (NPP) filed an application for a stay of execution to prevent the Electoral Commission and the NDC from acting on the annulment, pending the outcome of the Supreme Court case.
Commenting on the matter, the Deputy General Secretary of the NPP, Haruna Mohammed, told Citi News on Monday, December 15, that the party will await the Supreme Court’s decision before deciding its next steps.
“For now, there is no election until we get a definitive ruling from the court. What the court is going to say will inform our decision,” he said. He added that if the ruling favours the party, Mathew Nyindam will continue as the Member of Parliament for Kpandai.
Mr. Mohammed further indicated that the NPP would respond decisively if the ruling goes against them, stressing that the party will make its position clear once the Supreme Court delivers its verdict.
The outcome of today’s hearing is expected to have significant implications for the planned rerun of the Kpandai parliamentary election and the political atmosphere in the constituency.
